Icy Roads and No Insurance: What Happens If You’re Hit This Winter in Raleigh?

Winter weather brings icy roads, reduced visibility, and longer stopping distances—conditions that significantly increase the risk of car accidents across Raleigh and the Triangle. Unfortunately, winter also exposes another harsh reality: many drivers on the road are uninsured or underinsured.

When an uninsured driver loses control on a slick roadway, the consequences can be serious. Medical bills pile up quickly, vehicles are damaged, and the lack of insurance coverage adds a layer of financial stress at the worst possible time. Knowing how uninsured motorist (UM) coverage works—and how to protect yourself—can make all the difference during winter driving season.

Being involved in a car accident is stressful enough. But learning that the at-fault driver has no insurance can make an already difficult situation feel overwhelming. Unfortunately, uninsured motorists are more common than many drivers realize, including here in Raleigh and across North Carolina. If you are hit by someone without coverage, you still have options—but acting quickly and strategically is critical.

WHAT DOES IT MEAN WHEN THE OTHER DRIVER IS UNINSURED?

North Carolina law requires drivers to carry liability insurance, but not everyone follows the rules. When an uninsured driver causes an accident, they typically have no insurance company to pay for your medical bills, lost wages, or vehicle damage. That does not mean you are out of luck—it simply means the path to recovery looks different.

YOUR PRIMARY SOURCE OF COVERAGE: UNINSURED MOTORIST (UM) INSURANCE

Most North Carolina auto policies include Uninsured Motorist (UM) coverage. UM coverage is designed specifically for situations where the at-fault driver has no insurance. In effect, your own insurance company steps into the shoes of the uninsured driver and pays damages up to your policy limits.

However, UM claims are often more complicated than standard insurance claims. Insurance companies may dispute liability, minimize injuries, or undervalue claims—even when dealing with their own policyholders. This potentially opens up claims for “bad faith” which an experienced attorney can advise on.

WHAT TO DO IF YOU’RE HIT BY AN UNINSURED DRIVER

  • Call the police and ensure a crash report is filed
  • Seek medical attention immediately
  • Take pictures of the scene and the vehicles involved
  • Notify your insurance company
  • Avoid recorded statements without legal advice

THE TYPE OF ATTORNEY YOU MAY NEED

You should consult a personal injury attorney experienced with uninsured motorist claims and insurance disputes. These cases often require litigation experience and deep knowledge of North Carolina insurance law.

HOW TO PROTECT YOURSELF GOING FORWARD

  • Carry sufficient UM and UIM coverage – generally not expensive to add to your insurance policy.
  • Review insurance limits annually
  • Avoid minimum coverage policies
